1. Both in traditional and online commerce, ask for a ticket or invoice for all purchases on Black Friday

Asking for a ticket or invoices is the first tip to buy on Black Friday and assert all your rights as a consumer. Despite the discount with which you can purchase the product on Black Friday, you have the right to receive the ticket and the seller cannot refuse to issue any of these documents, not even in this period.

2. For online purchases on Black Friday, you have the right to a refund within 14 calendar days

Despite the fact that physical stores have joined the discount campaigns for Black Friday, this shopping period triumphs online, with the main electronic commerce carrying out aggressive advertising campaigns to attract the largest possible number of audiences and thus increase their sales.

In these cases of distance purchases, as we explained in the post "Guide on the right of withdrawal", You have the possibility to exercise your right of withdrawal, in other words, the return of the item purchased online. To do this, you have at least 14 calendar days from receipt of the purchase to enforce your right of withdrawal, although it has a series of exceptions that would not allow such a return of a purchase made on the Internet, such as, for For example, buying personalized calendars on Black Friday or custom shirts.

By exercising your right of withdrawal, You should not bear any cost for returning a product purchased remotelyAlthough, companies can establish in the condition of the contract that the expenses that this return entails, such as the carrier, are assumed by the buyer.

Just as the law establishes that, as a consumer, you have a minimum term -which can be improved by the company- of 14 calendar days to exercise the right of withdrawal, The employer has a period of 14 calendar days to return the amounts paid to the consumer. This period begins to count once you inform of your decision to exercise the right of withdrawal. If the employer does not proceed to return the amounts within the established deadlines, you can request said amount in duplicate, in addition to being able to claim compensation for possible damages.

3. For returns of purchases in a physical store, the commercial policy of each store must be analyzed

Currently, the law includes the return of the purchase in physical establishments only in cases in which said item has a manufacturing defect.

If the item is correctly and, for example, you want to return it because when you get home it no longer convinces you, the possibility of returning it will depend on what is known as the "commercial policy" of the store, also sometimes called " business courtesy".

Those items you buy during Black Friday must have the same legal guarantee as products purchased outside of this period of discounts.

This guarantee must be required from:

  • The store that sold the item.
  • If it is impossible to go to that establishment, you can go to the brand itself.

5. Identical quality standards

Just as we pointed out that, when buying on Black Friday at a discount, the businessman cannot reduce or eliminate the right to the guarantee that is included in the current legal regulations, the products offered for sale during Black Friday must be in perfect condition and comply with the standards quality set. The same as if you made the purchase without a discount or outside this commercial period.

6. Claims for problems with online purchases will depend on the headquarters of the electronic commerce

In online purchases, for claims, it is essential to take into account that it will vary depending on where the electronic commerce is based (Spain, European Union or a third country).

Below, we detail how to claim in each case if you have problems with your online purchase on Black Friday.

Claim online purchases on websites based in Spain or the EU

Steps to claim the company that sold the item on Black Friday if it is based in Spain:

  • The first step is to send a letter to the address that must appear on the website.
  • If the response does not occur or it is not convincing, you can address the claim to the corresponding Consumer Agency.

As for claiming companies not based in Spain for problems in electronic commerce, but in the European Union, you can claim on the ODR platform of the European Consumer Center.

The organisms that we have just indicated are voluntary for companies and consumers. That is, if the company does not want to accept this type of conflict resolution, you must initiate other ways to claim your rights.

Regarding going to court, depending on the problem and as long as it is a company based in Spain, this route could also be used to solve the problem.

Claim online purchases on web pages not based in Spain or the EU

The Internet allows you to buy on web pages from far away places, but when purchasing any item on a web page that is not based in Spain or the European Union, our advice is to assess whether it compensates, for example, for a lower price than the one found in Spain , buy that product on a website outside these territories, due to future problems that you could face if you have to claim your purchase online.

In these cases, you must address your claim to the bodies designated by that country, or initiate legal proceedings in said territory.
